Public Notaries Act 1997 – Schedule 1 – Clause 5 – Continuation of Roll of Notaries
Clause 5 of the First Schedule of the Public Notaries Act 1997 (NSW) states that there is a continuation of the roll of Notaries Public who were appointed under the old system pursuant to the provisions of the Public Notaries Act 1985 (NSW). More specifically, that clause states that:
The Roll of Notaries maintained under the repealed Act immediately before its repeal by this Act is taken for all purposes to be the roll of public notaries required to be established and maintained under section 7 of this Act.
This clause 5 is a further provision aiming to dispel any confusion or misunderstanding as to the legitimacy of Notaries Public who were appointed under the old system.
